1. Use of website and requirements to create an account with us

In order to use our website and/or receive our services, you need to be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any applicable law or regulation applicable to you.

   2. Key Commercial Terms Offered to Customers

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.    3. Return and Refund Policy

When purchasing online you have a statutory right to a 14-day 'cooling off’ period from the date of receipt. Within this period you can return the goods to us. In this instance the Customer will be liable for all return costs. Any goods must ​be returned to Mystic Magic packaged safely within the 14 days in the original condition as received (new, unused, unmarked, original packaging etc.). 

 

Goods with signs of usage, damage including wear and tear or mishandling will not be accepted. Credits or refunds will not ​be issued for any goods with damage caused to incorrect handling, storage or due to any misuse by the customer. Damage to goods during postage/shipping must be reported and returned to Mystic Magic within 48 hours. A suitable replacement will be offered wherever possible and dispatched upon receipt of damaged goods.
 

In the unlikely event of an item developing a fault due to manufacturing we will be pleased to rectify the problem free of charge within one year of purchase. This does not affect your statutory rights.

   4. Retention of Right to Change Offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

​All content including words and pictures depicted on the Mystic Magic website are subject to Copyright. You therefore forbidden to copy, reproduce, modify, distribute, republish, re-sell, display, post or transmit any section of this website without the express permission of Mystic Magic. You may view or print individual pages only for your own exclusive use.

All Mystic Magic products Masks, Head Wear, Accessories and Clothing are subjected to the copyright laws and are under no circumstances allowed to be copied or reproduced by any profitable business/person other than members of Mystic Magic.

   6. Right to Suspend or Cancel User Account 

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations.

 

 

   7. Indemnification

You agree to indemnify and hold Mystic Magic harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to or arising out of or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, in no event Mystic Magic, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. 

To the maximum extent permitted by applicable law, Mystic Magic assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

​   9. Right to change and modify Terms

We reserve the rights to modify these terms from time-to-time at our sole discretion.  Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by, a court of competent jurisdiction located in the UK. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

   12. Shipping and Delivery
Mystic Magic will take no personal liability for goods delayed or lost by Royal Mail or any other delivery services that are out of our control.
In the unlikely event of goods being "lost" in transit, a refund will be issued once a claim has been made from Royal Mail. It will need to be proven the goods have, indeed, been lost. Royal Mail do not consider an item as lost until 15 working days have elapsed.

Mystic Magic Flat Rate Delivery options are provided via the checkout page on our website. From the drop down menu select your country for correct postage to be added. Orders exceeding over the weight of 1kg and need to be packed in a larger box will be charged considerably more,

   13. Payment Method
For your personal security all card payment/refund services are currently handled directly via PayPal. Mystic Magic therefore has no access to your financial details and will therefore accept no liability for any financial issues accrediting to PayPal.

   14. Bespoke Designs

All bespoke work is commissioned in “good faith” to our highest possible standards. Design, costing and payment must be finalized prior to production. No design alterations can be accepted during or post production.
